This page lays out the terms of use on which you may use The Grove Online Library ("site"), whether as a guest or a registered user. Please read these terms of use carefully before you start to use the site. By using the site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using the site.

The Grove Online Library is owned by The Grove Library Services Ltd, a company registered in England and Wales whose registered office is at No 9 Wheatcroft Close, Milton Keynes MK6 4NJ (no post accepted at this address). Company Registration No. 8167798.

Accessing The Grove Online Library

Access to the site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the site without notice. We will not be liable if for any reason the site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of the site, or the entire site, to users who have registered with us.

If you have registered, your email address, registration number and password are confidential, and you must not disclose them to any third party. We have the right to disable any registration number, email address or password at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

When you register with us (or give Parental Consent for a minor who registers with us) you are stating that you are over 18 years of age. You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete.

By registering with the site you agree to receive the The Grove Online Library email newsletters. If you do not wish to receive these newsletters you can unsubscribe by using the link that appears on every newsletter that we send out.

RIGHTS

You may download, store in cache, display and print the material and information in an unaltered form for your own personal use only, provided that this notice appears with all copies. You must not systematically retrieve data or other content from this website to create or compile, directly or indirectly, a collection, compilation, database or directory, or, copy, re-transmit, distribute or commercialise any material or information on this website, without The Grove Online Library's prior written permission.

You must not modify any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of material on the site must always be acknowledged.

If you print off, copy or download any part of the site in breach of these terms of use, your right to use the site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Uploading material to The Grove Online Library

Any material you submit to The Grove Online Library will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. You also permit any The Grove Online Library members to access, display, view, store and reproduce such content for personal use. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to the site constitutes a violation of their intellectual property rights, or of their right to privacy.

The content that you may submit to the site should also contain factual and accurate material. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the site. We reserve the right to display advertisements in connection with your user content and to use your user content for advertising and promotional purposes.

Site updates

We aim to update the site regularly, and may change the content at any time. If the need arises, we may suspend access to the site, or close it indefinitely. Any of the material on the site may be out of date at any given time, and we will do our best but are under no obligation to update such material.

Information storage

We process information about you in accordance with our privacy policy which forms part of these terms and conditions. By using the site, you consent to such processing and you warrant that all data provided by you is accurate.

Membership

Membership is free of charge and starts as soon as you complete the registration form. This gives you full access to all the resources in the library, which you can download, save to your own computer and print off as authorised. After filling in the registration form you will be allocated a unique membership number and sent a confirmation request email to the address you entered on the form. You must click the link contained and highlighted within the email in order to validate your account and begin to use the services. If at any time you forget your member ID or password you may use the links we provide to retrieve them.

Cancellation

Should you wish to cancel your membership at any time, you can do so by contacting Customer Services at enquiries@thegrovelib.com or via The Grove Online Library site.

Misuse of the site

You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the site is stored or any server, computer or database connected to the site. You must not attack the site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site or to your downloading of any material posted on it, or on any website linked to it.

Links

You may link to the site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

The site must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

If you wish to make any use of material on the site other than that set out above, please address your request to enquiries@thegrovelib.com.

To provide increased value to users of the library, we may provide links to third party websites or resources (that are not part of The Grove Online Library) for you to access at your sole discretion. The Grove Online Library provides such links to you as a convenience only. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and shall not be responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use that others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources. It is your responsibility to exercise your own skill and care with respect to any material on those external websites. The Grove Online Library will not be liable for any loss or damage that may arise from or relating to a linked third party website.

Security

You must keep secret any personal identification numbers, passwords or other security codes that we may give you for access to The Grove Online Library's registration system, and comply with all reasonable instructions that The Grove Online Library may issue in relation to keeping such personal details safe. You should also make sure that any Internet payment transaction you make is done in a secure environment.

Protecting Your Privacy

Our overriding objective is to handle all data fairly and securely. Any information you give us about yourself will be stored on The Grove Online Library's systems and may be disclosed to, processed and used by us, and the other companies that assist us in providing our services.

To the extent that sensitive personal data is processed about you, we will employ appropriate security measures given the nature of that data. However, you recognise that your use of the Internet and our website is entirely at your own risk. We have tried to create a secure and reliable website for our users. However, we have no responsibility or liability for the security of personal information transmitted via the Internet.

The Grove Online Library, through our hardware technology partners, utilise the latest in Secure Server Technology to ensure that all personal and transactional information is protected to the highest standards. We never make your personal details available to companies outside The Grove Online Library for marketing purposes, although our representatives may hold your data so that your details can be processed and your account maintained.

Jurisdiction and Applicable Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
